Fireworks Display late at Night

If you are planning a private firework display which will take place between the hours of 11pm and 7am you will need to get consent. You still require to apply if the firework display is being held on the night of Chinese New Year, 5th November, Diwali or the 31st December but be aware that amended time restrictions apply on these days.

Fees

There is no application fee

We must receive your application no later than six weeks before the event.  We must be satisfied that risks have been competently assessed.  The event must be advertised in a local newspaper circulating in 51³Ô¹ÏÃâ·ÑApp and Bute no later than seven days prior to the event.

Eligibility Criteria

Applicants must be able to show that:

  • They or the person by whom they are employed is a professional organiser of firework displays
  • They or the person by whom they are employed hold(s) public liability insurance in respect of the use of fireworks at the event in question.

Also that the dispensation sought is:

  • For the purpose of putting on a firework display in the course of your business or employment as a professional organiser/operator of firework displays or
  • At a national public celebration or national commemorative event*

The Application process

A copy of your application will be submitted to Police Scotland as part of the consultation process and Community Councils and other representative bodies may also be consulted about your application. Your application form will also be included in the documents sent to members of the relevant Area Committee and as such will become a public document.

Receipt of your completed application form will be confirmed in writing. You will be contacted either with a note of the outcome of your application and any conditions that apply, and for any additional information to support your application.

Objections and Appeals

If you have been refused a licence or do not agree with the licence conditions imposed, you may appeal to the Chief Trading Standards Officer at the address above.

If you do not have a dispensation or do not comply with any of the conditions, you may be prosecuted and subject to a penalty determined by the criminal courts

If you have reason to complain about a firework display taking place between the hours of 11pm and 7am and you believe the operator does not have a fireworks dispensation please call your local police service to complain, preferably while the display is still taking place.
